Sean Combs’ attorney, Mark Agnifilo, has accused prosecutors of a “complete institutional failure” following a court hearing in New York on Tuesday, November 19. The rapper’s defense team claims that his constitutional rights were violated last month when federal investigators seized 19 pages of his notes during a search of his prison cell and handed them over to prosecutors.

Agnifilo argues that the seized materials include handwritten confidential notes from Diddy to his legal team, outlining defense strategies for his upcoming trial. Authorities also confiscated a “to-do list” written by Diddy, which reportedly included instructions for a family member to “find compromising material” on two of his alleged victims, as well as pages containing motivational quotes Diddy had written for himself. Agnifilo described the seizure as a “pre-planned purge” and a “pretext” for investigators to gain control over his client.
“We don’t know enough facts to determine what legal remedy is appropriate,” the attorney told the court.
Judge Arun Subramanian ruled that the prosecution must temporarily destroy all copies of the documents in their possession.

The emergency hearing took place after the defense filed new documents in court revealing that prosecutors were in possession of confidential materials obtained during a raid on Friday, October 28. Agnifilo informed the court that defense attorneys are currently reviewing the incident regarding the seizure of Combs’ personal records.

As a reminder, Diddy is currently in prison awaiting trial on charges of conspiracy to commit extortion, sex trafficking, and transporting individuals for prostitution. He was arrested on September 17, and is expected to face trial in May of next year. He denies all allegations.
